Single Bank Pooled Collateral

Banks and Trusts

Chapter 361 of the Missouri Revised Statutes (RSMo), establishes the Division of Finance within the Department of Commerce and Insurance. This chapter outlines the powers, duties, and responsibilities of the Director of Finance, including the regulation of banks, trust companies, and consumer credit businesses, as well as the liquidation of failing institutions.

Chapter 362 RSMo, governs Banks and Trust Companies. It covers the incorporation, regulation, powers, and operations of these financial institutions, including provisions on capital stock, branch banking, fiduciary responsibilities, and the Family Trust Company Fund.

As of December 31, 2025, there were 188 banks and three nondeposit trust companies regulated by the Missouri Division of Finance.

Missouri ranks fourth in the nation in the number of state-chartered banks. Assets in Missouri state-chartered banks totaled $214.4 billion, deposits totaled $182.1 billion, and loan volume totaled $146.9 billion.

Nondeposit trust companies are required to submit their total assets under management each January. These companies held a combined total of $21.5 billion in trust assets, according to December 31, 2022, annual reports.

Consumer Credit Lenders

Chapter 367 of the Missouri Revised Statutes (RSMo) addresses consumer credit loans and financial services.

Chapter 408 RSMo, governs legal tender and interest, including credit card and loan regulations.

The consumer credit section of the Missouri Division of Finance is responsible for licensing and regulating various types of consumer finance companies to assure compliance with numerous state and federal laws.

As of September 2025, there were approximately 2,200 such companies licensed by the Division of Finance.

Mortgage Companies and Originators

Sections 443.701 - 443.893 RSMo, authorizes the Division of Finance to enforce laws regulating residential mortgage brokers and mortgage originators. Enforcement includes licensing and investigative powers.

A license is required to broker, fund, service or purchase residential mortgage loans unless the individual or company qualifies for an exemption. Before issuing a license, the Division of Finance is required to investigate each applicant for character, general fitness, experience and financial responsibility.
